Plagiarism Issue: Which website will be penalized, first published content or last published content

If we found the same content on 2 different websites which website will be penalized by search engine Google, first published content or last published content ?

Google does not really know who published the first and second. It depends on what one they indexed first.

The best thing to do is to send a DMCA take down notice to the website and their host. If that does not get it taken down, send a second DMCA take down notice to the hosts upstream host, Google and any site that links to the article.
